1. Scope of Application

1.1 For the use of the AV Portal of TIB and for ordering DVDs, the following Special Conditions shall apply. The provision of films for publication in the AV Portal and the provision of sublicences is subject to a separate agreement.

1.2 For other services and portals provided by TIB in addition to the AV Portal, other special conditions may apply.

1.3 TIB provides these Conditions in German and English. In case of differences between the English and the German version, the German version prevails.

2. Registration in the AV Portal

2.1 A search can be performed in the AV Portal without registration. Due to legal reasons, some content can only be made available to a restricted group of customers. To access this content a registration is required.

2.2 The following criteria apply for the attribution of a customer to a specific customer group:

Commercial Customer:
A customer is a commercial customer, if he is either the owner of a firm, otherwise working for profit or part of such a firm or institution. Publicly funded libraries who have been approved of by TIB and who have the status similar to a national or state library, university library, regional library, library of a university of applied sciences, public library or specialised library, generally are not deemed to be commercial customers.

Non-commercial Customer in the domain of education and research:
A customer is a non commercial customer in the domain of education and research, if the use of the material is directed towards private education and further education or teaching, lecturing and examination purposes in all publicly accessible schools independently of the funding body, as well as institutions for education, further education and vocational training, as long as not only single private courses are taught. Material is used for research purposes, when employed for the own scientific use (including researching, presenting and teaching) and no commercial purpose is pursued.

Non-commercial customers are also all other customers, which do not belong to either of the customer groups defined above.

If a non-commercial Customer makes use of the services for commercial purposes, the Customer must register as a commercial customer.

2.3 The Customer warrants, that the chosen Customer group is correct and all services of the AV Portal the Customer avails himself of are made use of in functions which are characteristic for the specific Customer group.

2.4 The Login Details may be blocked for cause by TIB. A cause can be a breach of the Terms of Use or these Conditions or a legal obligation or official order for TIB to block the access or any other conduct, which raises the suspicion that the Customer will violate the Terms of Use, these Special Conditions or other legal obligations also in the future.

2.5 TIB will block Login Details at the request of the Customer, if all claims are settled.
